SPORTS TRAINING AS THE OBJECT OF INTELLECTUAL PROPERTY RIGHTS

Abstract

Aim. The aim of this article is to find the most efficient way for the legal protection of sports training as a result of creative activity. Materials and methods. We studied several bright cases on the protection of sports training by means of the patent law. Results. Summarizing the results of judicial and Rospatent practice, we made a conclusion that each method of protection including the institute of the patent law and the institute of know-how does not provide sufficient protection. Moreover, obtaining a patent is connected with one serious difficulty as the current law allows patenting the method, but the method is regarded as the impact of one material object to the other material object. We revealed that patenting of the ways and methods of sports training complies with the law and makes sense. We also revealed the conditions of obtaining such patents. Conclusion. In conclusion we proposed to combine the provisions of know-how and patent law for the most efficient protection of sports training.
